7.3 We may suspend or terminate access or operation of the Site at any time as we see fit. 8 Hyperlinks and third party sites

The Site may contain hyperlinks or references to third party advertising and websites other than the Site. Any such hyperlinks or references are provided for your convenience only. If such third-party sites involve the collection of your personal data, you should be aware that they operate independently and are not governed by our privacy practices. You are responsible for reviewing their personal data policies to ensure compliance with the PDPA.

We have no control over third party advertising or websites and accept no legal responsibility for any content, material or information contained in them. If you access or submit personal data to a third-party site through a link from our Site, such personal data will be subject to the third party’s own policies and not to our responsibilities under the PDPA.

The display of any hyperlink and reference to any third party advertising or website does not mean that we endorse that third party’s website, products or services. You must carefully assess whether your disclosure or use of personal data through those external sites is lawful, and you must not assume that any data transfer through such links is compliant with PDPA cross-border or consent requirements.

Your use of a third party site may be governed by the terms and conditions of that third-party site and is at your own risk. If your activity on a linked site results in the disclosure of personal data, we disclaim all responsibility under the PDPA for how that data is processed, stored, or transferred by the third party.

9 Our responsibility to you

9.1 We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage. Where our Site or services involve the processing of your personal data under the PDPA, we will take reasonable and appropriate steps to safeguard such data against misuse, loss, or unauthorised disclosure, but we shall not be liable for any consequence arising from your own failure to comply with applicable data protection obligations under Thai law.

10 Events beyond our control

We are not liable to you if we fail to comply with these Terms because of circumstances beyond our reasonable control. This includes, but is not limited to, system failures, internet outages, acts of government, or legal restrictions. Where such events result in disruption to the protection, access, or exercise of your rights relating to personal data under the PDPA, we will take reasonable steps to resume compliance as soon as practicable and minimise any impact on your data subject rights.

11 No third party rights

No one other than us or you has any right to enforce any of these Terms. However, if any third party gains access to your personal data through your use of the Site—whether by your action or via embedded third-party services—such third party shall be independently responsible for its compliance with the PDPA. These Terms do not create any obligation on our part to enforce or monitor a third party’s compliance with data protection laws.

12.1 No changes to these Terms are valid or have any effect unless agreed by us in writing or made in accordance with this clause 12. In cases where changes affect how we collect, use, or disclose your personal data, we will notify you in accordance with the requirements of the PDPA, including obtaining renewed consent where required.

12.2 We reserve the right to vary these Terms from time to time. Our updated Terms will be displayed on the Site and by continuing to use and access the Site following such changes, you agree to be bound by any variation made by us. Where those changes involve personal data processing, we will ensure that such variations do not exceed the original purpose notified to you, unless permitted under the PDPA.
